25/08/23: the linked document concerns a complaint by me, James Collings, against the Development and Planning Authority (DPA) of Guernsey regarding their conduct between 28 November 2019 and 11 February 2020. The complaint was referred to the Administrative Review Board on 20 July 2022.

The Review Board upheld the complaint on 25 August 2023. They found no evidence of impropriety but acknowledged procedural errors by the DPA and the perception of a conflict of interest in how the original complaints were handled.

The Review Board requested the DPA reconsider the matter by 31 October 2023. The reconsideration should be carried out by an independent senior person with no prior involvement in the complaint. It should look at all relevant matters relating to the DPA’s decision to issue a Certificate of Lawful Use to Mr Collings for his property Bonamy House between the dates of 28 November 2019 and 11 February 2020.

The Review Board stated its expectation that the reconsideration should focus on the DPA’s process and decision-making regarding the Certificate of Lawful Use, not re-examining the decision itself.

If the Review Board feels the DPA has not sufficiently reconsidered the complaint, they must refer the matter to the States of Deliberation.
